Hong Kong Bill Gives Mediation Body Power to Break Deadlocks

The Hong Kong government has introduced a bill in the Legislative Council to amend the Mediation Ordinance, giving the Hong Kong Mediation Accreditation Association Limited (HKMAAL) statutory power to break deadlocks in mediation proceedings.

Moving the second reading of the 2026 Mediation (Amendment) Bill on Wednesday, Secretary for Justice Paul Lam said the bill would allow either party to apply to HKMAAL to decide the number of mediators or appoint one when mediation agreement parties have not agreed on such matters. The move follows recommendations from a working group set up in October 2024 to study the territory's mediation regulation system.

The working group finalised seven recommendations after detailed review, research and stakeholder consultation. These cover three core points: mediation should remain a non-licensed activity in Hong Kong, consistent with international practice in developed common law jurisdictions such as Australia, Canada, Singapore and the UK, which do not impose mandatory registration or certification; mediators should remain under rigorous professional oversight through HKMAAL; and legislative and administrative measures should be used together to strengthen HKMAAL's functions and leadership.

The bill would give HKMAAL the statutory power to decide the number of mediators or appoint a mediator in specified circumstances when mediation agreement parties cannot reach agreement. The department stressed the bill upholds the voluntary and flexible nature of mediation, with parties remaining free not to mediate, to agree otherwise, or to appoint a different mediator. The Hong Kong Court's powers to give directions or orders in mediation or case management, including on mediator selection, are unaffected.

HKMAAL was established in 2012 as a company limited by guarantee by the Hong Kong Bar Association, the Law Society of Hong Kong, the Hong Kong International Arbitration Centre and the Hong Kong Mediation Centre. Its institutional membership has since more than doubled, now including bodies such as the Hong Kong Family Welfare Society and professional institutes. Its register lists more than 2,400 accredited general mediators and more than 360 accredited family mediators.

The government consulted the Panel on Administration of Justice and Legal Affairs on June 2, 2025, and stakeholders in September 2025, with most respondents supporting the recommendations. Further consultation on the draft bill's key provisions took place from June to July 2026. The Hong Kong Mediation Accreditation Association Limited would be given statutory power to decide the number of mediators or appoint mediators when parties have not agreed, helping break deadlocks while preserving the voluntary nature of mediation.
