Two registered minor works contractors disciplined over building offences

Two registered minor works contractors and their authorised signatories have been disciplined by the Minor Works Contractors Disciplinary Committee, with written rulings and orders published in the Government Gazette on 6 November 2026.

In the first case, a contractor and its authorised signatory were convicted at Tuen Mun Magistrates' Court in August 2024 for breaching sections 40(2E) and 40(5) of the Buildings Ordinance. They had submitted a certificate in December 2022 confirming completion of a Category III Type C minor works project involving alteration of a wall sign at a shop in Yuen Long. However, investigations by the Buildings Department found that the contractor and signatory were not registered for that type of works. They were fined a total of HK$12,000. The disciplinary committee ordered the contractor's removal from the register within two months of the gazette notice and fined the authorised signatory HK$4,000. Both must also pay HK$42,000 in hearing costs.

In the second case, a contractor submitted a notification in July 2022 for a Category II minor works project to install a wall sign of not more than 10 square metres at a building in Shaukiwan. However, the sign's display area exceeded 10 square metres, making it a Category I project requiring engagement of prescribed building professionals. The contractor and its authorised signatory, who was also a director, were convicted at Eastern Magistrates' Court in May 2024 for breaching sections 40(2A)(c), 40(2A)(e) and 40(6) of the Buildings Ordinance. They were fined a total of HK$16,000. The disciplinary committee ordered the contractor's removal from the register within two months and a fine of HK$4,000, while the authorised signatory and director was fined HK$12,000. They must also pay HK$46,300 in hearing costs.

A Buildings Department spokesman reiterated that if registered contractors breach the Buildings Ordinance, are convicted of building-related offences, or are found negligent or guilty of misconduct, the department may take enforcement action including criminal prosecution and disciplinary measures.
