Labour Department investigates fatal work accident in Sha Tin

The Labour Department of the Hong Kong Special Administrative Region Government is investigating a fatal work accident that occurred in Sha Tin on 5 November 2026. A spokesperson said the department immediately sent officers to the scene after learning of the incident.

The department has issued a 'suspension of work notice' to the contractor concerned, ordering a halt to all work on the site's vehicle access road until the contractor takes appropriate measures to eliminate the hazards. The investigation is proceeding at full speed to determine the cause of the accident, identify the legal responsibilities of relevant parties and propose remedial measures.

To prevent workers from being struck by vehicles, the Labour Department reminded employers to take adequate precautions, including installing suitable barriers to separate workers from vehicle pathways. Where barriers cannot be erected, employers must ensure a safe distance between workers and vehicles. Employers must also provide high-visibility vests and ensure their correct use.

Under the general duty provisions of the Occupational Safety and Health Ordinance, employers must provide a safe working environment, work equipment and systems. Violations carry a maximum fine of HK$10 million and up to two years' imprisonment.

The Labour Department will issue a 'safety alert' via its 'Occupational Safety and Health 2.0' mobile application, website and email, notifying responsible parties, trade unions and professional safety organisations about the accident and reminding the industry to adopt preventive measures to avoid similar incidents.

The department will urge the employer to fulfil its compensation obligations under the Employees' Compensation Ordinance, assist the family of the deceased in filing compensation claims and closely follow up the case. For families facing financial hardship, the department will help them apply for suitable emergency relief funds. Depending on the family's needs and wishes, the department will also contact the Social Welfare Department for financial or other assistance.

The Labour Department called on employers to provide safe and healthy work equipment and systems, and on employees to cooperate with their employers, comply with all safety measures and properly use provided personal protective equipment to avoid endangering themselves or others.
